Linn Grove Regular City Council Meeting June 11, 2003

at the Linn Grove Community Center at 7:00 p.m.

Mayor Graesing called the meeting to order.

Moved by Smith to adopt the agenda as amended.  Seconded by Warkentin.  Motion carried.

Moved by Warkentin to adopt Resolution 2003-7, a Resolution whereas, effective May 14, 2003, the position as City Councilmember for the City of Linn Grove has been vacated due to the resignation of Amy Jessen.  Whereas, the Council has the option to appoint a successor Councilmember for the balance of the unexpired term of the office vacated subject to the right of electors to petition for a special election: Now, therefore, be it resolved by the City Council of the City of Linn Grove, Iowa; That the following named person, Denise Jurgensen, in accordance with the provisions of Section 372.13(2) is hereby appointed to fill the vacancy created by the resignation of Councilmember Amy Jessen.  Such appointment shall be effective June 11, 2003 upon the “Oath of Office” being administered and shall be for the balance of the unexpired term of Councilmember Amy Jessen unless sufficient numbers of electors shall petition for a special election.  Seconded by Ellis.  A roll call vote was taken with the voting as follows:  Ellis-Aye, Smith-Aye, Warkentin-Aye, Wadsley-Aye.

“Oath of Office”.  City Clerk administered the “Oath of Office” to Denise Jurgensen.

Members present: Smith, Wadsley, Warkentin, Ellis, Jurgensen.

Members absent: None.

In attendance: Art & Sinda Teepe.

Moved by Ellis to approve previous special meeting minutes as read from May 21, 2003.  Seconded by Smith.  Motion carried.

Moved by Smith to approve building addition located at 106 Grove Street with the restrictions being as follows: Make addition as presentable as possible, progress must be shown, and addition to be completed by November 1st, 2003.  Seconded by Wadsley.  Motion carried.

Old Business.  Two of the previous abatements sent out last month have complied.  Moved by Ellis to send final “Abate the Nuisance” to 203 Linn Street, Linn Grove, IA.  Seconded by Jurgensen.  Motion carried.

New Business. 

Approval of Bills.  Moved by Wadsley to approve all bills as presented.  Seconded by Ellis.  Motion carried.

Park Board Report.  Water hydrant to be installed located at City Park also the footings will be poured for park monument when contractor arrives.  Water Wheel Expenditures.  Moved by Smith to approve installation and expenditures incurred for the project located in the horseshoe court.  Seconded by Jurgensen.  Motion carried.

Library Board Report.  None.

Maintenance Report.  Consumer Confidence Report was posted at the Linn Grove Post Office, Linn Grove Community Center/Library, and at First State Bank, also report was on utility bills letting the public know the report is available upon request at the City Clerk’s office.  Electric Pump installed 2 new cutters at the lagoons and did maintenance work.  Blacktop Services  will begin sealcoating streets.  Clerk informed Council that the removal of old cement and installation of new sidewalk billing will be sent to 203 S. Weaver Street, Linn Grove.

City Clerk Report.  Moved by Warkentin to approve cigarette permit for Bobby’s Sand Bar.  Seconded by Ellis.  Motion carried.  Moved by Ellis to suspend the three reading rule required to pass an Ordinance.  Seconded by Warkentin.  A roll call vote was taken with voting as follows: Wadsley-Aye, Ellis-Aye, Smith-Aye, Warkentin-Aye, Jurgensen-Aye.  Moved by Wadsley to adopt Ordinance 605, an Ordinance increasing fees for Solid Waste Collection from $13.25 to $14.25 per month for each residential premises and for each dwelling unit of a multiple-family dwelling.  Code of Ordinances Linn Grove, IA chapter 106 Section 106.08.  Seconded by Jurgensen.  A roll call vote was taken with voting as follows:  Smith-Aye, Warkentin-Aye, Ellis-Aye, Wadsley-Aye, Jurgensen-Aye.  Moved by Ellis to suspend the three reading rule required to pass an Ordinance.  Seconded by Wadsley.  A roll call vote was taken with the voting as follows: Jurgensen-Aye, Warkentin-Aye, Ellis-Aye, Wadsley-Aye, Smith-Aye.  Moved by Wadsley to adopt Ordinance 606, an Ordinance increasing fees for water service provided by the City based upon use of water determined by meters and for water service provided to any customer located outside the corporate limits of the City, which the City has agreed to serve.  Code of Ordinances Linn Grove, IA Chapter 92 Section 92.02 and 92.03.  Seconded by Smith.  A roll call vote was taken with voting as follows: Jurgensen-Aye, Warkentin-Aye, Ellis-Aye, Wadsley-Aye, Smith-Aye.  Rates effective July 1st, 2003.

Moved by Ellis to temporarily extend the fenced in beer garden area located at 112 Weaver Street Linn Grove for Bobby’s Sand Bar on June 21st, 2003 through 2:00 a.m. June 22nd, 2003 only.  Seconded by Warkentin.  Motion carried.  Moved by Smith to send “Abate the Nuisance” to 301 Sweet Street Linn Grove Parcel #02-08-176-001 and 311 Sweet Street Linn Grove Parcel #02-08-176-005.  Seconded by Wadsley.  Motion carried.  Moved by Warkentin for Mayor Graesing to proceed to contact personnel for clean-up of property located at 301 Sweet Street Linn Grove Parcel #02-08-176-001 and 311 Sweet Street Linn Grove Parcel #02-08-176-005 if owners don’t comply to abatement.  Seconded by Ellis.  Motion carried.

Resolution for Jamboree June 21st, 2003.  Moved by Ellis to adopt Resolution 2003-8, A Resolution for a 1 day waiver effective June 21st, 2003 only on Linn Grove code of Ordinances Chapter 136 Section 136.17 & 136.18 regarding merchandise display and sales stands.  This Resolution also to include closing north end of Linn Street from 203 Linn Street to 100 Weaver Street Linn Grove, IA effective June 21st, 2003 only.  Also the closure of the alley running parallel with Weaver Street and connecting Weaver Street to Linn Street located in downtown area of Linn Grove.  No parking allowed between 100 Weaver and 132 Weaver Street Linn Grove, IA effective June 21st, 2003 only.  Temporary stop signs to be placed at 100 Weaver Street and 132 Weaver Street Linn Grove, IA effective June 21st, 2003 only.  At 6:00 p.m. the temporary stop signs will be removed and parking will be restored on the downtown area of Weaver Street Linn Grove, IA.  Seconded by Wadsley.  A roll call vote was taken will the voting as follows: Wadsley-Aye, Ellis-Aye, Warkentin-Aye, Smith-Aye, Jurgensen-Aye.

Announcements-Open Forum.  Moved by Warkentin to approve a building permit request by John Smith.  Seconded by Jurgensen.  Motion carried.  Smith abstaining.  Moved by Ellis to move can collection container to City Property in front of 107 Weaver by street light.  Seconded by Wadsley.  Motion carried.  Jim Carlson, First Co-op representative, formally announced Card-Trol coming to Linn Grove.

Moved by Wadsley to adjourn.  Seconded by Smith.  Time 8:45 p.m.
