The Linn Grove Regular City Council meeting was held at the Linn Grove Community Center on December 14, 2005 at 7:00 p.m.

Mayor Smith called the meeting to order.

Members present: Wadsley, Nelson, Weier, Jurgensen, Ellis.

Members absent:  None.

In attendance: Arnie Hicks.

Adopt the Agenda.  Moved by Ellis to adopt the agenda.  Seconded by Nelson.  All ayes.  Motion carried.

Approve Previous Meeting Minutes.  Moved by Jurgensen to approve previous meeting minutes as read from November 9, 2005.  Seconded by Nelson.  All ayes.  Motion carried.

Administer Oath of Office.  The Oath of Office was given to John Smith, Mayor, Councilpersons John Nelson and Marlin Weier on November 22, 2005 for their positions to take effect immediately.  The Oath of Office was given to Councilpersons Ronda Ellis, Denise Jurgensen, and Arnie Hicks on December 14, 2005 to be effective January 1, 2006.

Old Business.

 Wastewater Meeting Update.  Mayor Smith and Gene Johnson attended this informational meeting regarding compliancy for new mandated laws.  Mayor Smith reported to Council that because our sewer lagoons are discharged only 2 or 3 times a year that Linn Grove should be compliant. 

Library Meeting Update.  Council was informed that Mayor Smith and City Clerk met with 2 library board members and head librarian to discuss how finances are handled between the city and library. 

Lease Business Property Agreement-Resolution 2005-11.  Moved by Ellis to approve Resolution 2005-11, a Resolution to enter into a lease property agreement with Lora Johnson/Curtain Creations for property located at 100 Weaver Street, Linn Grove, Iowa.  Seconded by Jurgensen.  A roll call vote was taken with voting as follows: Ellis-Aye, Wadsley-Aye, Jurgensen-Aye, Nelson-Aye, Weier-Aye.  Motion carried.

New Business.

 Approval of Bills & Clerk/Treasurer’s Financial Reports.  Moved by Nelson to approve Clerk/Treasurer’s Financial Reports and all bills as presented.  Seconded by Weier.  All ayes.  Motion carried.

Park Board Report.  None

Library Board Report.  No meeting held in December.

Maintenance Report.  Repairs on Rental Property.  Mayor Smith reported to Council regarding needed repairs on furnace and plumbing.  Council was informed that snow equipment and operators are prepared for snow season.

City Clerk Report.  Water Re-Connect Fee Ordinance #801.  Moved by Ellis to adopt 1^st reading of Ordinance No. 801, an Ordinance amending Title II Public Service and Health Chapter 1: Public Water System Article 3: Water Rates Section Modified by adding Article 3:10 of the 2004 Recodification of the Municipal Code of the City of Linn Grove.  Seconded by Wadsley.  A roll call vote was taken with the voting as follows:  Wadsley-Aye, Jurgensen-Aye, Ellis-Aye, Nelson-Aye, Weier-Aye.  Motion carried.  Moved by Jurgensen to waive the 2^nd & 3^rd readings of Ordinance No. 801.  Seconded by Nelson.  A roll call vote was taken with the voting as follows:  Jurgensen-Aye, Ellis-Aye, Wadsley-Aye, Weier-Aye, Nelson-Aye.  Motion carried.  Moved by Wadsley to adopt Ordinance No. 801, amending Water Rates Section.  Seconded by Nelson.  A roll call vote was taken with voting as follows:  Ellis-Aye, Wadsley-Aye, Jurgensen-Aye, Nelson-Aye, Weier-Aye.  Motion carried.  Sex Offender Ordinance #802.  Moved by Ellis to adopt 1^st reading of Ordinance No. 802, an Ordinance amending Title III, Chapter 1 of the Linn Grove Code of Ordinances by adopting a new Article 7(A) entitled “Sex Offender Residency Restrictions.”  Seconded by Wadsley.  A roll call vote was taken with the voting as follows:  Wadsley-Aye, Jurgensen-Aye, Ellis-Aye, Nelson-Aye, Weier-Aye.  Motion carried.  Moved by Wadsley to waive the 2^nd and 3^rd readings of Ordinance No. 802.  Seconded by Jurgensen.  A roll call vote was taken with voting as follows:  Jurgensen-Aye, Ellis-Aye, Wadsley-Aye, Weier-Aye, Nelson-Aye.   Motion carried.  Moved by Nelson to adopt Ordinance No. 802 amending Title III, Chapter 1 of the Linn Grove Code of Ordinances Article 7(A) entitled “Sex Offender Residency Restrictions.”  Seconded by Ellis.  A roll call vote was taken with voting as follows:  Ellis-Aye, Wadsley-Aye, Jurgensen-Aye, Nelson-Aye, Weier-Aye.  Motion carried.  Council Meeting-Amending Code of Ordinance.  Moved by Weier to amend the Linn Grove City Code of Ordinance Title 1 Administrative Code Legislative Chapter 3 Article 9 Council 9.04 Meetings regarding changing regular city council meeting from 2^nd Wednesday of month to 2^nd Thursday of month.  Seconded by Nelson.  All ayes.  Motion carried.  Abatements.  Moved by Wadsley to send abatements to 2 residences in Linn Grove.  Seconded by Nelson.  All ayes.  Motion carried.  Mayor Compensation.  Moved by Ellis to approve paying Mayor Smith for last quarter of year 2005 $300 for mayoral duties.  Seconded by Nelson.  All ayes.  Motion carried.  Advisory Positions and Contacts.  Moved by Nelson to approve Mayor Smith’s advisory positions and contact personnel effective 1/1/06.  Seconded by Jurgensen.  All ayes.  Motion carried.

Update of Meetings Attended by City Clerk.  Clerk informed Council of meetings that she attended regarding city budget, IPERS, and Municipal Leadership Academy on December 8^th at Cherokee.  Budget Discussion.  Tabled until January meeting.  Correspondence, Etc.  Clerk informed Council that ILEC and Iowa Telecom would be raising rates effective January 2006.  Council discussed letter received from Northwest Iowa Alcoholism & Drug Treatment Unit asking for annual support.  Clerk informed Council of meeting with Kim Johnson regarding the BV County Comp Plan.  City Clerk and Kim Johnson went over a questionnaire.  Johnson will be in contact to attend February council meeting. 

Announcements-Open Forum.  Council discussed meeting with Barnes Township Trustees regarding fire department.  Wadsley informed Council that he would no longer represent the City of Linn Grove on the BV County Comp Plan Steering Committee.  Plans to burn the City brush pile were discussed.  Ellis talked to Council about the American Legion doing repairs on their building and the City’s existing wall.  Wadsley presented a letter to Council regarding conduct of Linn Grove Library.  Wadsley received a “Thank You” from the Mayor and City Council for his years of serving on the city council.
