The Linn Grove Regular City Council meeting was held on September 8, 2004 at the Linn Grove Community Center at 7:00 p.m.

Mayor Graesing called the meeting to order.

Members present: Weier, Smith, Jurgensen, Wadsley, Ellis.

Members absent: None.

In attendance: Bob & Barb Cox, Patria Jenson, Lolita Weier, Fay Theeler, Kevin Weier, Kay Richards, Ross & Valorie Craig.

Moved by Smith to adopt the agenda.  Seconded by Weier.  Motion carried.

Moved by Jurgensen to approve previous meeting minutes as read from August 11, 2004.  Seconded by Ellis.  Motion carried.

Old Business.

Abate the Nuisance Update.  Moved by Wadsley to continue to monitor parcel #02-08-154-003 property owners will have 30 days to complete improvements.  Seconded by Ellis.  Motion carried.

Construction Agreement Between City & BV County Resolution 2004-7.  Moved by Wadsley to adopt Resolution 2004-7, a Resolution for construction agreement between City of Linn Grove and Buena Vista County consenting and approving the plans for the improvement of the extension of Secondary Road bridge replacement on Bluff Street within the City of Linn Grove, Iowa.  Seconded by Jurgensen.  A roll call vote was taken with the voting as follows: Ellis-Aye, Wadsley-Aye, Jurgensen-Aye, Weier-Aye, Smith-Aye.

New Business.

Approval of Bills.  Moved by Jurgensen to approve all bills as presented.  Seconded by Smith.  Motion carried.

Barking Dogs.  Larry Sangl arrived at 7:40 p.m. Larry Sangl requested permission to shoot an air rifle on his property.  Moved by Smith to grant Larry Sangl his request provided he comply with City, State, and Federal gun laws.  Seconded by Wadsley.  Motion carried.  Ross Craig stated he would file a written complaint on the weapons request with the City Clerk.  Larry Sangl voiced his complaint about the Craig’s dogs and the habitual barking.  The Craig’s were informed that the situation will be monitored and that they will need to control the dogs’ barking.  Moved by Smith to allow the Craig’s 6 months to reduce the number of dogs on their property from 4 dogs to 3 dogs. The Linn Grove Code of Ordinance Book states that no more than 3 adult dogs are allowed at a residence.  Seconded by Weier.  Motion carried.

Can Receptacle.  Mayor Graesing met with Kim Johnson, BV County Environmental Health, and conducted an inspection of the Linn Grove can collection site on Weaver Street.  Kim Johnson filed a verbal report to the Mayor and found there to be no health problems to the public at this site. 

Abate the Nuisance.  Moved by Weier to send an abatement to parcel #02-08-105-012 for junk vehicles and overgrowth of grass and weeds.  Seconded by Wadsley.  Motion carried.

Park Board Report.  A total of $1130.00 has been raised towards the matching funds of $1800.00 needed for the park gazebo.

Library Board Report.  Patria Jenson reported to Council that the fundraiser is still ongoing until September 25th.  Library President and librarian expressed their concerns of Mayor’s conduct during library hours.  Mayor suggested Council censure him on this matter.  Moved by Ellis to censure Mayor Graesing’s conduct in the library.  Seconded by Weier.  Motion carried.

Maintenance Report.  Mayor Graesing and Gene Johnson have been consulting on the duckweed problem at the lagoons.  Plans to install 2 new fire hydrants were discussed by the Mayor and Council.

City Clerk Report.  Rob Wadsley has volunteered to represent the City of Linn Grove for the Comp Board Committee.  Larry Sangl has acquired the need for the pop can receptacle and will be removing it for personal purposes.  Moved by Wadsley to designate the Linn Grove Community Enhancement Foundation as the official recipient of the can collection receptacle.  Seconded by Smith.  Motion carried.  Wadsley will submit a proposal at the next regular city council meeting as to the replacement of the current can collection receptacle. 

Announcements-Open Forum.

Councilperson Ellis commented on how nice the park benches up by school monument looked.

Wadsley informed Council about the front door on the community center.  The door will need some repairs to make it handicap accessible.  Moved by Smith to contact residents living at 402 South Weaver St. due to visibility problem on their corner with the possibility of involving outside consulting services for this problem.  Seconded by Weier.  Motion carried.  Mayor expressed unsettled feelings of the last 2 weeks and ended conversation about the subject stating that  “when people are so willing to believe an unsubstantiated lie about the worst of someone; what does that say about us as a people.”  Moved by Jurgensen to state that the Mayor and City Clerk have the City Council’s full support in the performance of their jobs and personal conduct.  Seconded by Ellis.  Motion carried.

Moved by Ellis to adjourn.  Seconded by Jurgensen.  Time 8:50 p.m.
