Linn Grove Regular City Council Meeting at
the Linn Grove Community Center March 10, 2004 at 7:00 p.m. Mayor Graesing
called the meeting to order. Members present:
Weier, Jurgensen, Smith, Wadsley, Ellis. Members absent:
None. In attendance:
None. Moved by Weier to
adopt the agenda. Seconded by Smith. Motion carried. Moved by Jurgensen
to approve previous meeting minutes as read from February 1, 2004. Seconded by
Weier. Motion carried. Mayor Graesing
opened the Linn Grove City Budget Hearing at 7:05 p.m. Upon hearing no
objections the Linn Grove City Budget Hearing closed at 7:20 p.m. Moved by
Smith to approve Resolution 2004-1, a Resolution approving the Linn Grove City
Budget for fiscal year ending June 30, 2005. Seconded by Ellis. A roll call
vote was taken with voting as follows: Ellis-Aye, Wadsley-Aye, Smith-Aye,
Jurgensen-Aye, Weier-Aye. Old Business. Code of Ordinance
Update. The Linn Grove City Code of Ordinances is in the final stages of
updating and the public hearing date will be set in April. New Business. Approval of Bills.
Moved by Jurgensen to approve all bills as presented. Seconded by Wadsley.

Report. Bluff Street Bridge Resolution 2004-2. Moved by Smith to approve
Resolution 2004-2, a Resolution authorizing the Mayor to sign agreement with the
Iowa Department of Transportation and the City of Linn Grove regarding federal
aid highway bridge replacement and rehabilitation (HBRR) program project. This
would be funding to replace the bridge located on Bluff Street Linn Grove,
Iowa. Seconded by Wadsley. A roll call vote was taken with the voting as
follows: Ellis-Aye, Wadsley-Aye, Jurgensen-Aye, Smith-Aye, Weier-Aye. Mayor and
Council discussed ordering chemicals to treat the sewer lagoon. City Clerk Report.
Resolution 2004-3-Authorizing immediate payment for certain bills/expenses.
Moved by Weier to approve Resolution 2004-3, a Resolution to authorize the Clerk
to issue checks for immediate payment of amounts due which if not paid promptly
would result in loss of discount, penalty for late payment, or additional
interest cost. Any such payments made shall be reported to the Council for
review and approval with and in the same manner as other claims at the next
meeting following such payment. This Resolution authorizing immediate payment
may include but is not limited to payment of utility bills, contractual
obligations, payroll, and bond principal and interest. Seconded by Wadsley. A
roll call vote was taken with the voting as follows: Wadsley-Aye, Smith-Aye,
Jurgensen-Aye, Weier-Aye, Ellis-Aye. Appoint City
Attorney. Moved by Jurgensen to appoint Hemphill Law Office (Don Hemphill)
Spencer, Iowa as the official city attorney for the City of Linn Grove for year
2004. Seconded by Wadsley. Motion carried. Liquor License Approval. Moved by
Ellis to approve the liquor license renewal and also outdoor service and Sunday
sales privilege for Bobby’s Sand Bar. Seconded by Weier. Motion carried.
Garbage Contract. Moved by Wadsley to give the Mayor the authority to sign
contract with Arny Grow Garbage Hauling Service and authorizing the Mayor and
Utility Manager to collectively deal with any problems that may arise during the
term of this contract. Binding contract between the City of Linn Grove and Arny
Grow Garbage Hauling Service. Grow’s Garbage Hauling Service agrees to pickup
garbage at all residences in Linn Grove with the following exceptions: residents
residing at 110 Linn St. & 211 Railroad St. Linn Grove, Iowa. These exceptions
have been given designated pick-up locations because of logistical problems.
Monthly fee assessed to the City of Linn Grove will be $800. Grow’s Garbage
Hauling Service must provide Proof of Insurance on an annual basis to the City
of Linn Grove. Seconded by Weier. Motion carried. Iowa DOT Grant Money
Awarded. Mayor Graesing informed Council that he received a letter from the
Iowa DOT informing him that the Iowa DOT has approved the Keep Iowa Beautiful (KIB)
program funding application for $3000. More details to follow regarding this
grant money. Correspondence Sent and Received. Clerk informed Council of an
unpaid water bill if no response from customer the unpaid water bill will be
sent to the BV County Treasurer to be collected with the general property tax.
Moved by Wadsley to express the Council’s willingness and support to the Local
Government Innovation Fund which Kim Johnson Zoning Director is the acting
project manager. Seconded by Ellis. Motion carried. Abate the Nuisance. Moved by Weier to send an “Abate the
Nuisance” to residents of Linn Grove regarding junk and unlicensed vehicles.
Seconded by Ellis. Motion carried. Announcements-Open Forum. Moved by Smith to send
letter to Monte & Kathy Scholten regarding terms of the lease agreement between
the City of Linn Grove and the Scholtens. Seconded by Ellis. Motion carried. Moved by Smith to adjourn. Seconded by Wadsley. Time 9:10
